The plaintiff was required to undergo extensive treatment in order to treat the massive brain insult. She ultimately had a tubing implanted in her brain that ran dow her back and entered the peritoneum where excessive cerebral spinal fluid would drain in order to prevent hydrocephalous.

Saling v. TBTA et. al.

The plaintiff was riding his motorcycle across the Harlem Lift span of the RFK Bridge when his tires entered into a man made rut between the middle and right hand lanes of Manhattan bound traffic. He continues to travel forward while the sidewall of his tires contacted the elevated edges made by the elevations on either side of the rut. The forces from this contacting created an upward force making it impossible for the plaintiff to make use of his steering mechanism. When his front tire contacted a transverse joint that intersected the rut, he was thrown over his handle bars sliding forward on the roadway surface until his head contacted the bridge sidewall. His most significant injury was an anterior inferior frontal lobe injury that altered his personality and compromised his ability to control his anger response.

The doctor was supposed to run a connecting wire from the head down to a battery pack in the small of the lower back, but instead ran the wire upwards losing its location at the neck area and the tip entered the hole in the base of the plaintiff’s brain causing massive injury.
